Webtier Srl (hereinafter Webtier), with registered office in Rome, in via Simone Martini n. 135, has drawn up, in a simple and comprehensible way, this document, regarding the processing of personal data.

Processing of personal data means any operation or set of operations, performed with or without the aid of electronic tools, concerning the collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure, and destruction of data, even if not recorded in a database.

This information is aimed at users registered on the website www.webtier.cloud and to users who purchase our services.

The information and data provided will be processed in compliance with applicable laws and regulations (including, but not limited to, the General Data Protection Regulation – EU Regulation 2016/679 – General Data Protection Regulation or “GDPR”).

WEBTIER will process your data in accordance with the principles of fairness, lawfulness, transparency, accuracy, integrity, confidentiality, purpose limitation, data retention, and data minimization.

 

WHO IS THE DATA CONTROLLER?

THE LEGAL BASES OF THE PROCESSING OF YOUR PERSONAL DATA

WEBTIER bases the processing of personal data on various legal bases:

  1. consent (only when necessary or permitted by law), expressed clearly and unequivocally and always revocable.
  2. the establishment of a contractual relationship and the fulfillment of the obligations arising from it;
  3. the need to comply with applicable laws and to establish, exercise or defend legal claims;
  4. the need to respond to requests from users;
  5. any other legal basis permitted by current regulations.

 

WHAT KIND OF PERSONAL DATA DO WE PROCESS, FOR WHAT PURPOSES AND FOR HOW LONG DO WE KEEP IT?

  1. Browsing data

For the proper functioning of the WebTier website and the services provided, computer systems and software procedures are required. During their normal operation, they acquire certain personal data, the transmission of which is implicit in the use of internet communication protocols. This data is not collected to be associated with identified individuals, but by its very nature, it could, through processing and association with data held by third parties, allow users to be identified (e.g., IP addresses). This data is used solely for anonymous statistical information regarding the use of the service and to verify its proper functioning. It is retained for the period strictly necessary and in accordance with applicable regulations.

2. Personal data of registered users

In order to provide the services set forth in the contractual agreements and conduct marketing activities, WEBTIER will collect the following customer data: First Name, Last Name, Username, Password, and Email Addresses. This data will be retained for the purposes of providing the services and for promotional activities for a period of 10 years from the termination of the contractual relationship. For tax purposes and other legal obligations, the same data will be retained for 10 years, unless the law permits a longer retention period, including due to the statute of limitations on any rights claimed by third parties.

3. Data of third parties provided by the interested party

Users may provide third-party data to request domain names. In such circumstances, the registered user will be the sole data controller, with the associated legal obligations and responsibilities. This data will be retained exclusively for tax purposes (invoicing) for a period of 10 years and for 6 months from the cancellation of the domain name to which it refers (third-party domain registration), unless the law requires or permits a longer retention period.

4. Cookies

Access to the site www.webtier.cloud This may involve our servers sending so-called "cookies" to the user's computer. These are files that allow us to obtain information on the pages visited in order to speed up the use of various services. The use of cookies is limited to the duration of a single session and does not in any way allow the acquisition of personal data that identifies the user. The data acquired will not be stored but will be deleted when the browser is closed. These communications may also be personalized based on your preferences (expressly indicated by you or inferred from your visits to the WebTier website or from links you click). Before initiating any marketing activity and if required by applicable law, we will ask you for your consent. You can withdraw your consent by sending an email to rpd@webtier.cloud. Even if you withdraw your consent to receiving marketing communications, you may still receive other types of communications (for example, important technical or administrative notices).

 

WHO ARE THE RECIPIENTS OF THE PERSONAL DATA

The recipients of the personal data collected are:

  • people, companies, professional firms that provide consultancy services;
  • subjects who provide services related to the collection of payments (for example bank transfer, credit card);
  • any persons who carry out maintenance activities on network equipment and communications networks;
  • other bodies or authorities to whom, for legal reasons or obligations, it is necessary to communicate your personal data;
  • persons authorized by WEBTIER to carry out activities necessary for the provision of services (with a legal obligation of confidentiality).

TRANSFER OF PERSONAL DATA

In order to be able to provide some services regulated in the contract, some of your data may be transferred outside the European Economic Area.

In the aforementioned circumstances, the companies receiving the data guarantee us protection standards, thanks to appropriate technical, organizational, and legal measures.

WHAT RIGHTS CAN YOU EXERCISE

Among the rights that can be exercised by users of the site who have provided their personal data for the purposes described above, provided that the conditions established by the legislation from time to time are met (in particular, Articles 15 et seq. of the Regulation), are:

  • the right to know whether the Data Controller is processing personal data concerning them and, in this case, to have access to the data being processed and all the information relating to it;
  • the right to rectification of inaccurate personal data concerning them and/or to completion of incomplete data;
  • the right to erasure of personal data concerning them;
  • the right to limit processing;
  • the right to object to processing;
  • the right to portability of personal data concerning them.

In any case, the interested party has the right to submit a formal Complaint to the Italian Data Protection Authority, according to the methods available on the Guarantor's website.

CHANGES TO THIS PRIVACY POLICY

WEBTIER may modify or update the content of this policy.
